The court sentenced the son of the Symferopil city council MP Vitali Faingold to three years of imprisonment with deprivation of the right to manage traffic for three years. Earlier his car collided with motor cycler Hanna Mishutkyna. The court decided to release him from punishment on probation for two years. The judge of the Railway district court of Symferopil made a sentence on it today, UNIAN reports.
Vitali Faingold is adjudged guilty of a crime under Part 2 of Article 286 of the Criminal Code of Ukraine - a violation of traffic road safety, resulting in death.
Vitali Faingold must not leave a permanent residence outside Ukraine without the permission of the correctional inspections, must report changes of residence and work, and periodically be registered.
The court rejected the father of Hanna Mishutkyna Oleksandr Hoppe in the satisfaction of a claim to Vitaly Faingold on recovery of moral damages in the amount of Hr 500,000. "The daughter died in such circumstances, and such punishment!" - outraged Oleksandr Hoppe, talking to reporters. He said that he intends to apply to the Court of Appeal.
The lawyer of Vitali Faingold Anatoly Zhukov is pleased with the decision of the court. "I think it is a fair sentence," - he said. The lawyer noted that the court recognized the mutual form of guilt, but his client partly compensated damage to the relatives of the deceased.
It was announced at the trial that the former husband of Hanna Mishutkyna Denis Mishutkin received from Vital Faingold Hr 500,000 and has no claims to the accused. Another 125,000 were received by the father motor cycler Oleksandr Hoppe.
As a reminder, at the night on Sept. 16, 2008 near the railway station in Symferopil accident took place involving a motorcycle Suzuki and Bentley car. After impact, the Suzuki was thrown at another car, and Bentley collided with two cars. Motor cycler received serious injuries and died at the scene of the accident. As experts established, Bentley moved at a speed 171 kilometers per hour.
